What Is the Probate Process in Atlas, Michigan?
The probate process begins when a person passes away and has assets that need to be transferred to their heirs. The process can be relatively simple if the deceased person had a comprehensive estate plan in place, or it can be more complex if the decedent died without a will or trust.
Here is a brief overview of the probate process in Atlas:
- Filing the will: When a person passes away, the original will must be filed with the probate court in the county where the person lived. If the person did not have a will, the court will appoint an executor to oversee the estate.
- Appointing an executor: If the decedent had a will, it will name an executor to administer the estate. If the person did not have a will or the named executor is unable or unwilling to serve, the court will appoint an executor. The executor is responsible for managing the estate throughout the probate process.
- Identifying and appraising assets: The executor is responsible for identifying and locating the decedent’s assets. The executor must also have the assets appraised to determine their value.
- Notifying creditors and paying debts: The executor must notify the decedent’s creditors that the person has passed away. The creditors then have a limited amount of time to file a claim against the estate, or the claim is barred. The executor is responsible for paying any valid debts using estate funds.
- Filing the final tax return: The executor must file the deceased person’s final tax return and pay any taxes that are owed.
- Transferring assets to beneficiaries: After all debts and taxes are paid, the executor can distribute the remaining assets to the beneficiaries named in the will. If the person died without a will, the assets will be distributed according to Michigan’s intestate succession laws.
The probate process can take anywhere from a few months to a year or more, depending on the complexity of the estate and whether any disputes arise. Our Atlas probate attorneys can help you navigate the process and ensure that all legal requirements are met.
